Bright Labs

Terms of service

Last updated

The seller is Mark Delos Santos, trading as Bright Labs ("we", "us"). These terms apply to every product we sell on brightlabs.app. By buying or using a product you agree to them.

Please read them with our refund policy and our privacy policy. If something here is unclear, ask us at hello@brightlabs.app before you buy.

1. Who we are and what we sell

Bright Labs makes small software products. At the date above these are PHPReady, a WordPress plugin, with its paid add-on PHPReady Pro, and FlakeRadar, a Chrome extension, with its paid plan FlakeRadar Pro. Each product's page on this site describes what it does, what each plan includes and what it costs.

A "product" in these terms means any of that software, in its free or paid form. A "paid plan" means a subscription bought through this site. Some products are marked Beta on their pages. A Beta product works and can be bought, and it is still changing more often than a finished product does.

2. Payments and Paddle

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

This means your purchase is a sale from Paddle to you. Paddle takes the payment, charges any tax, issues the receipt and handles billing questions. Paddle's own buyer terms, at https://www.paddle.com/legal/buyer-terms, apply to that sale. We supply the product itself and answer questions about how it works.

We do not ask for or receive your card details, and we will never ask you to pay us outside Paddle's checkout.

3. Prices and tax

Prices are shown in US dollars. Paddle may add sales tax or VAT at checkout, depending on where you live. The checkout shows the full amount before you pay, and the amount on your Paddle receipt is what you paid.

A plan marked "Planned price" or "Checkout opens soon" is not on sale yet. Its price may change before it opens, and nothing is charged until you complete a checkout.

4. Subscriptions, renewal and cancelling

Paid plans are subscriptions. A subscription renews automatically at the end of each billing period, and Paddle charges the payment method you used until you cancel. The product page shows the price and billing period of each plan.

You can cancel any time, at paddle.net or by emailing hello@brightlabs.app. Your cancellation takes effect at the end of the billing period you have already paid for, and you keep the paid features until then. Cancelling stops future payments. It does not by itself refund a payment already made; section 5 covers refunds.

If we change the price of a plan, the new price applies to new orders. We will not raise the price of an existing subscription without telling you first by email, at the address you used at checkout, so that you can cancel before the new price applies.

5. Refunds

You can get a full refund within 14 days of any payment, for any reason. See the refund policy for how to ask.

6. Free versions

7. License keys and what your plan covers

When a paid plan's first payment completes, you get a license key. It is shown on the checkout page and emailed to the address you used at checkout. If you lose it, the Pro page can send it again to that address. The key turns on the paid features for as long as your subscription is active.

A plan covers what its page says. PHPReady Pro is priced per site, so one subscription covers one WordPress site. PHPReady Agency covers up to 25 sites. Please do not publish your key or pass it to people your plan does not cover. If you need more than your plan covers, buy another plan or write to us.

When a subscription ends, or a payment is refunded in full or charged back, the key can no longer be renewed. The paid features turn off at the product's next renewal check, and no later than the key's end date, about three days after the billing period you paid for. The product then goes back to its free limits. Your data is not deleted because of this, and the free version keeps working.

PHPReady and PHPReady Pro are licensed under the GNU General Public License, version 2 or later. PHPReady includes third-party open-source components under their own licenses, named in its readme. Those licenses give you their rights in the code, and nothing in these terms takes those rights away. These terms still govern the paid plan, the license key and the license service.

8. Using the products

Use the products lawfully and respect the terms of any third-party service they work with. You are responsible for your own website, store and data. Keep a backup before you change products or settings in bulk.

In particular, please do not:

9. What the products can and cannot tell you

Our products are tools that help you make a decision. They do not make it for you, and their results can be incomplete or wrong.

PHPReady reads code without running it. Static analysis can miss problems and can flag code that would run without trouble, so a clean scan does not promise that an upgrade will go smoothly, and a held-back update does not prove that the update is broken. Test changes on a staging copy where you can, and keep a backup.

FlakeRadar labels a failing check from the history it can read in your repository. A label is evidence with its counts shown beside it, not a verdict. A check labelled as a known flake can still be a real failure, so read the evidence before you merge or re-run.

10. Third-party services

Our products work with services we do not run, including WordPress, WordPress.org, GitHub and Google Chrome. Their terms apply to your use of them, and we are not responsible for changes they make or for their availability. If a change on their side stops a feature from working, we will try to adapt, and your right to a refund under section 5 is not affected.

FlakeRadar is not affiliated with or endorsed by GitHub. You create your own GitHub token and you decide what it can access. FlakeRadar sends a re-run request only when you click to send one.

11. Support

For help with a product, email hello@brightlabs.app. We read every message and answer as soon as we can, but we do not promise a response time or a fix within a set time. Questions about a charge, a receipt or a refund can also go to Paddle at paddle.net.

12. Changes and availability

We may update a product to fix problems or keep it working. If we change these terms, we will update the date at the top of this page. Changes apply from that date, and they do not take away a refund you already have a right to.

We may stop selling a product. If we stop a paid plan, we will tell its subscribers by email and end those subscriptions, so that nobody is charged again for something we no longer offer. We do not promise that the license service or any product will be available without interruption.

13. Ownership

Except for rights given by an open-source license (section 7), we keep all rights in our products, our name and this site. Your website, repositories and data stay yours; we claim no rights in them. If you send us a suggestion, we may use it without owing you anything.

14. Liability

The products are provided as is. To the extent the law allows, we are not liable for indirect or consequential loss. Nothing in these terms limits your rights as a consumer under the law where you live.

To the extent the law allows, our total liability for any claim about a product is limited to what you paid for that product in the 12 months before the claim. For a free product, that means we accept no payment-based liability, because you paid nothing. We do not limit liability for anything the law does not allow us to limit, such as fraud.

15. If you stop using a product

You can stop at any time by cancelling any subscription and removing the product. Removing FlakeRadar deletes the data it stored in your browser. Deleting PHPReady from WordPress removes its settings and scan results. Sections 9, 13 and 14 still apply after you stop, for anything that happened while you used the product.

16. General

If part of these terms cannot be enforced, the rest still applies. If we do not act on a breach straight away, we can still act on it later. These terms are the whole agreement between you and us about the products, alongside the refund policy and the privacy policy, and do not change Paddle's terms for the sale itself. You may not pass your rights under them to someone else without our agreement.
